1. Acceptance and scope

By creating an account or using Tarot Ink, you agree to these Terms of Service ("Terms"). If you do not agree, do not use the service.

These Terms govern your use of the Tarot Ink mobile application, website (tarotink.com), and all related services (collectively, the "Service"). They form a binding agreement between you and Tarot Ink.

2. The service

Tarot Ink is a digital tool for personal tarot practice. It provides:

• Daily card pulls and tarot readings
• Custom deck creation with AI-generated artwork
• Personalized reading history and insights
• Social features for sharing readings with friends

3. Accounts

To use most features, you must create an account. You agree to:

• Provide accurate information during registration
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Maintain only one account per person

You are responsible for all activity under your account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. AI-generated content

Tarot Ink uses artificial intelligence (currently Google Gemini) to generate readings, interpretations, and card artwork. You acknowledge and agree that:

• All readings and card artwork are AI-generated, not created by human tarot readers or artists. This is disclosed in accordance with the EU AI Act (Article 50).
• AI output may be inaccurate, incomplete, or unsuitable. AI models can produce unexpected or incorrect results. We do not guarantee the accuracy, quality, or appropriateness of any AI-generated content.
• AI output is not unique. Similar prompts may produce similar or identical results for different users.
• Your data is processed by third-party AI services. When you use reading or deck creation features, relevant data (your question, selected cards, and optionally your birth chart details) is sent to Google Gemini for processing. See our Privacy Policy for details.
• Readings are not predictions. AI-generated tarot readings do not predict future events. Tarot is a tool for reflection, not divination.

5. Intellectual property

Our content

The Tarot Ink application, its design, branding, original artwork, and underlying code are owned by Tarot Ink or its licensors. You may not copy, modify, distribute, or reverse engineer any part of the Service.

AI-generated content

Card artwork and readings generated through the Service are created by AI at your direction. You receive a limited, non-exclusive, non-transferable license to use this content for personal, non-commercial purposes within and in connection with the Service. We do not claim ownership of AI-generated content produced at your request, but we retain the right to use anonymized, aggregated patterns to improve the Service.

Preset deck artwork

Default and preset card artwork included in the app is owned by Tarot Ink and is licensed to you for personal use within the Service only.

6. User content

You retain ownership of any content you submit to the Service (questions, profile information, avatars, shared readings). By submitting content, you grant Tarot Ink a limited, worldwide, royalty-free license to store, process, display, and transmit that content as necessary to operate the Service -- including generating AI readings from your questions and displaying shared content to other users you have chosen to share with.

You may delete your content at any time through the app. When you delete content or your account, we will remove it in accordance with our Privacy Policy.

7. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to the Service or its systems
• Scrape, crawl, or use automated tools to extract data from the Service
• Resell, redistribute, or commercially exploit AI-generated content
• Interfere with or disrupt the Service for other users
• Impersonate another person or misrepresent your identity
• Submit content that is illegal, harmful, abusive, or violates others' rights
• Use the Service to generate content that violates applicable law or our AI provider's content policies

8. Liability

This section describes the limits of our liability. It is written to comply with German law (BGB Sections 307-309).

Unlimited liability

Nothing in these Terms limits our liability for:

• Intent (Vorsatz) or gross negligence (grobe Fahrlassigkeit)
• Injury to life, body, or health
• Liability under the German Product Liability Act (Produkthaftungsgesetz)
• Fraudulent concealment of defects
• Any mandatory statutory liability that cannot be excluded

Limited liability for simple negligence

For breaches of material contractual obligations (Kardinalpflichten) caused by simple negligence, our liability is limited to the foreseeable, typically occurring damages at the time of contract formation. Material contractual obligations are those whose fulfillment is essential to the proper execution of the contract and on which you may regularly rely.

Service provided "as is"

To the extent permitted by applicable law, the Service is provided on an "as is" and "as available" basis. We do not warrant that:

• The Service will be uninterrupted or error-free
• AI-generated content will be accurate, complete, or appropriate
• The Service will meet your specific requirements
• Any defects will be corrected in a particular timeframe

Scope of the Service

Tarot Ink provides entertainment and tools for personal reflection. It does not provide medical, psychological, financial, legal, or any other form of professional advice. We bear no liability for decisions you make based on AI-generated readings or content. If you are experiencing a crisis, please contact a qualified professional or emergency service.

9. Indemnification

To the extent permitted by applicable consumer protection law, you agree to indemnify and hold Tarot Ink harmless from any claims, damages, or expenses arising from your violation of these Terms, your misuse of the Service, or your violation of any third-party rights. This does not apply where the claim results from our own negligence or fault.

10. Service modifications and availability

We reserve the right to modify, update, or discontinue any part of the Service at any time. For material changes that affect your use:

• We will provide at least 30 days notice before discontinuing core features
• We will notify you through the app or by email
• If you disagree with changes, you may delete your account

We do not guarantee any specific uptime or availability. The Service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control.

11. Termination

By you: You may terminate your account at any time by deleting it through the app. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.

By us: We may suspend or terminate your account if you violate these Terms, engage in abusive behavior, or if we reasonably believe your use threatens the Service or other users. Where possible, we will provide notice and an opportunity to remedy the violation before termination.

Upon termination, your right to use the Service ceases. Sections relating to intellectual property, liability, indemnification, and governing law survive termination.

12. Governing law and disputes

These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

If you are a consumer resident in the EU, you also benefit from any mandatory provisions of consumer protection law in your country of residence. Nothing in these Terms affects your rights as a consumer to bring proceedings in the courts of your home jurisdiction.

The European Commission provides an online dispute resolution platform at ec.europa.eu/consumers/odr. We are not obligated and not willing to participate in dispute resolution proceedings before a consumer arbitration board.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

14. Changes to these terms

We may revise these Terms from time to time. If we make material changes, we will notify you at least 30 days before they take effect through the app or by email. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms. If you do not agree with the changes, you may delete your account before they take effect.
